On-Line Payment Terms And Conditions

Payments for certain insurance products can be made on-line with selected credit cards through this web site. The payment processing service ("Payment Service") is provided by a third party.

These terms and conditions together with the Terms of Use will apply to the Payment Service provided by the third party provider. Any reference to the phrase "this web site" in these terms and conditions also incorporates by definition the third party's website.

By using the Payment Service you agree to the following terms and conditions together with the Terms of Use.

Modification or suspension

Without notice or liability to you Ansvar Insurance may in its sole discretion and at any time:

  1. Vary the credit cards accepted by it and/or the insurance products that may be paid for through the Payment Service.
  2. Cancel or suspend the Payment Service or alter any part of it.

When a payment is made

When making a payment via the Payment Service, your payment will not be deemed to have been made until such time as:

  1. You have entered via the Payment Service your reference number, your name, the details of a current and valid credit card of a type which we accept and all other information required by Ansvar Insurance to obtain payment from your credit card issuer (together "Information");
  2. We receive all of the Information from you; and
  3. We have successfully made a charge against your nominated credit card and have received full payment for all applicable amounts due for the policy.

If we receive payment from your credit card issuer but it is subsequently reversed or dishonoured for any reason whatsoever then the payment will be deemed not to have been made to us.

If any previous period of insurance has expired before Ansvar Insurance receives full payment then you will be uninsured during that intervening period.

Your representations to us

In entering and submitting the Information to us you are:

  1. Authorising Ansvar Insurance to use the Information to request and obtain payment from your credit card issuer.
  2. Warranting to Ansvar Insurance that:
    1. The credit card is issued in your name and that you are authorised to incur charges against that credit card; and
    2. You have verified that the Information is accurate and complete before submitting the Information for processing.

Ansvar Insurance shall have no liability to you whatsoever and howsoever arising if your warranties above are untrue.

Confirmation

In its sole discretion Ansvar Insurance may or may not issue a confirmation to you about your payment transaction (whether via the web site, by email or otherwise). Whether a valid payment is made does not depend on Ansvar Insurance issuing or generating, or you receiving, a confirmation of the transaction.

Security

You are responsible for keeping the computer you are making the payment from free from viruses and malicious programs, and maintaining all appropriate security measures. You acknowledge that your failure to do so may lead to, amongst other things, the interception of data by unauthorised parties. Ansvar Insurance shall have no liability to you whatsoever if you suffer any loss that is caused wholly or in part by your failure to keep secure the computer you are making a payment from.

Disclaimer

Ansvar Insurance does not make any warranties representations or guarantees that the Payment Service will function as intended, be secure, or its operation will be continuous or be uninterrupted. All implied terms conditions and warranties regarding the functionality and security of the Payment Service are excluded to the fullest extent possible, except for those that cannot be lawfully excluded.

You agree and acknowledge that internet transmissions are never entirely secure or private and that any information sent by you (including credit card information) may be read or intercepted by others. We have no liability to you arising out of or in connection with the interception of data by unauthorised parties or for any events beyond the reasonable control of Ansvar Insurance.

Limitation of Liability

The terms within the Limitation of Liability section recorded within the Terms of Use on this web site also apply to any direct, indirect, special and/or consequential losses damages or losses of profits arising out of or in connection with your use of the Payment Service, including (without limitation) the exclusion relating to the negligence of, or any act or omission by, Ansvar Insurance. If, despite the terms of any exclusion or limitation of liability, Ansvar Insurance is found to be liable to you for any damages, losses, costs or expenses arising from or connected with your use of the Payment Service, then the liability of Ansvar Insurance in total aggregate shall not exceed the dollar amount of the payment you made or $1000, whichever is the lesser.
